2. Hosting und Shopsystem (Big Cartel)
Unser Shop läuft auf der Plattform Big Cartel, LLC, 50 W. Broadway #333 PMB 40632, Salt Lake City, UT 84101, USA. Big Cartel stellt die Website, den Warenkorb und die Kasse bereit und verarbeitet dabei die Daten, die beim Besuch und bei einer Bestellung anfallen. Beim Aufruf jeder Seite werden technische Zugriffsdaten verarbeitet (IP-Adresse, Datum und Uhrzeit, aufgerufene Seite, Browser, Betriebssystem, Referrer). Das ist nötig, um die Website sicher und stabil auszuliefern (Art. 6 Abs. 1 lit. f DSGVO). Big Cartel nutzt dafür auch den Sicherheits- und Auslieferungsdienst Cloudflare. Daten können dabei in die USA übermittelt werden; Big Cartel sichert solche Übermittlungen nach eigenen Angaben durch EU-Standardvertragsklauseln bzw. ein anerkanntes Angemessenheitsverfahren ab. 3. Bestellungen
Wenn du bestellst, verarbeiten wir die an der Kasse angegebenen Daten (Name, Liefer- und Rechnungsadresse, E-Mail-Adresse, ggf. Telefonnummer, bestellte Artikel, Zahlungsstatus), um den Vertrag zu erfüllen, die Ware zu versenden und mit dir zu kommunizieren (Art. 6 Abs. 1 lit. b DSGVO). Zur Zustellung geben wir Name und Lieferadresse an das beauftragte Versandunternehmen weiter (DHL/Deutsche Post, Hermes, DPD oder UPS). Aufgrund handels- und steuerrechtlicher Pflichten speichern wir Bestell- und Rechnungsdaten bis zu 10 Jahre (Art. 6 Abs. 1 lit. c DSGVO).

4. Zahlungsdienstleister
Je nach gewählter Zahlungsart werden deine Zahlungsdaten an den jeweiligen Anbieter übermittelt (Art. 6 Abs. 1 lit. b DSGVO; Betrugsprävention: Art. 6 Abs. 1 lit. f DSGVO):

Wir selbst sehen und speichern keine vollständigen Kartendaten.

5. Cookies und ähnliche Technologien
Beim ersten Besuch fragen wir dich in der Cookie-Leiste unten auf der Seite („cookies.exe") nach deiner Entscheidung. Du kannst den Shop sofort nutzen – während du entscheidest, wird nichts blockiert. Deine Wahl kannst du jederzeit über „Cookie settings" im Footer ändern.

Notwendig (immer aktiv, keine Einwilligung erforderlich – § 25 Abs. 2 TDDDG, Art. 6 Abs. 1 lit. b und f DSGVO):
• cart – speichert deinen Warenkorb (Big Cartel)
• tfe_consent – speichert deine Cookie-Entscheidung (12 Monate)
• tfe_drop_seen (Local Storage) – merkt sich, wann du das „New Drop"-Fenster zuletzt gesehen hast, damit es nur einmal pro Stunde erscheint
• Session Storage (tfe-booted, tfe-nd, tfe-wd) – merkt sich die Intro-Animation, speichert Drop-Infos zwischen und hält Eingaben der Widerrufsfunktion bis zum Absenden; wird beim Schließen des Browsers gelöscht
• Sicherheits-Cookies von Cloudflare (z. B. __cf_bm, cf_clearance) – Schutz vor Bots und Angriffen
• Stripe (__stripe_mid, __stripe_sid) und PayPal – Betrugsprävention bei der Zahlung

Statistik (nur mit Einwilligung – § 25 Abs. 1 TDDDG, Art. 6 Abs. 1 lit. a DSGVO):
• Besucherstatistik von Big Cartel (ident, _bca, visited; stats1.bigcartel.com) – zählt Besuche und angesehene Produkte, damit wir sehen, welche Stücke gefragt sind. Wird nur gesetzt, wenn du auf „Accept" klickst.

Zusätzlich nutzt unser Hoster Cloudflare Web Analytics; das arbeitet ohne Cookies und verarbeitet nur technische Zugriffsdaten (Art. 6 Abs. 1 lit. f DSGVO).
Deine Einwilligung kannst du jederzeit mit Wirkung für die Zukunft über „Cookie settings" widerrufen.

6. Schriftarten, Videos und Skripte
Schriftarten und Videos werden über das Content Delivery Network jsDelivr (cdn.jsdelivr.net, betrieben von Prospect One, Polen; Auslieferung über Cloudflare und Fastly) ausgeliefert, eine Programmbibliothek (jQuery) über cdnjs (Cloudflare, Inc.). Dabei wird deine IP-Adresse an den jeweiligen Anbieter übertragen, ggf. auch in die USA. Wir nutzen diese Dienste für eine schnelle und zuverlässige Darstellung unserer Website (Art. 6 Abs. 1 lit. f DSGVO). Diese Dienste setzen keine Cookies.

7. Kontaktformular, E-Mail und Instagram-Nachrichten
Wenn du uns über das Kontaktformular, per E-Mail oder per Direktnachricht schreibst, verarbeiten wir deine Angaben, um deine Anfrage zu beantworten (Art. 6 Abs. 1 lit. b bzw. f DSGVO). Das Kontaktformular wird von Big Cartel bereitgestellt und durch Google reCAPTCHA (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland) vor Spam geschützt; dabei werden Nutzungsdaten wie IP-Adresse und Mausbewegungen an Google übertragen, ggf. auch in die USA (Art. 6 Abs. 1 lit. f DSGVO – Schutz vor Missbrauch). Unser E-Mail-Postfach wird von Google (Gmail; Google Ireland Limited) bereitgestellt, Instagram-Direktnachrichten von Meta Platforms Ireland Limited (Merrion Road, Dublin 4, Irland); dabei kann eine Übermittlung in die USA stattfinden. reCAPTCHA kann das Cookie _GRECAPTCHA setzen. Wir löschen Anfragen, sobald sie erledigt sind, außer gesetzliche Aufbewahrungspflichten stehen dem entgegen.

8. Widerrufsfunktion („Vertrag widerrufen")
Nutzt du die Online-Widerrufsfunktion, verarbeiten wir deinen Namen, deine E-Mail-Adresse, die Angaben zur Bestellung und den Zeitpunkt des Widerrufs, um den Widerruf abzuwickeln und dir die gesetzlich vorgeschriebene Eingangsbestätigung zu senden (Art. 6 Abs. 1 lit. c DSGVO i. V. m. § 356a BGB). Die Erklärung wird über das Kontaktformular von Big Cartel an uns übermittelt. Die Eingangsbestätigung versenden wir per E-Mail über Brevo (Sendinblue SAS, siehe Ziffer 9) oder aus unserem E-Mail-Postfach (Gmail) – bei Brevo wird deine E-Mail-Adresse mit den Widerrufsangaben in einer separaten Liste gespeichert, die nicht für Werbung genutzt wird. Wir speichern diese Daten, solange es für die Abwicklung und etwaige Nachweise erforderlich ist, höchstens bis zum Ablauf der gesetzlichen Aufbewahrungsfristen.

9. Newsletter (Brevo)
Wenn du dich für unseren Newsletter anmeldest, nutzen wir den E-Mail-Dienst Brevo (Sendinblue SAS, 106 boulevard Haussmann, 75008 Paris, Frankreich) als Auftragsverarbeiter. Wir verwenden das Double-Opt-in-Verfahren: Du wirst erst eingetragen, nachdem du den Link in unserer Bestätigungs-E-Mail angeklickt hast. Wir speichern Anmeldezeitpunkt und Bestätigung als Nachweis. Brevo kann auswerten, ob ein Newsletter geöffnet und welche Links angeklickt wurden, damit wir unsere E-Mails verbessern können. Rechtsgrundlage ist deine Einwilligung (Art. 6 Abs. 1 lit. a DSGVO). 10. Links zu sozialen Netzwerken
Auf unserer Website verlinken wir auf Instagram, TikTok und YouTube. Es handelt sich um einfache Links; beim Besuch unseres Shops werden keine Daten an diese Netzwerke übertragen. Erst wenn du einen Link anklickst, gelten die Datenschutzbestimmungen des jeweiligen Anbieters.

11. Speicherdauer
Wir speichern personenbezogene Daten nur so lange, wie es für den jeweiligen Zweck nötig ist oder gesetzliche Aufbewahrungspflichten bestehen (6, 8 bzw. 10 Jahre nach HGB und AO).

12. Deine Rechte
Du hast das Recht auf Auskunft (Art. 15 DSGVO), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18), Datenübertragbarkeit (Art. 20) und kannst erteilte Einwilligungen jederzeit mit Wirkung für die Zukunft widerrufen (Art. 7 Abs. 3). Widerspruchsrecht (Art. 21 DSGVO): Soweit wir Daten auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse) verarbeiten, kannst du dieser Verarbeitung aus Gründen, die sich aus deiner besonderen Situation ergeben, jederzeit widersprechen.

13. Pflicht zur Bereitstellung
Für eine Bestellung benötigen wir die an der Kasse als Pflichtfeld markierten Angaben; ohne sie können wir den Vertrag nicht abschließen. Eine automatisierte Entscheidungsfindung oder ein Profiling findet durch uns nicht statt. Wählst du Klarna, kann Klarna eine Bonitätsprüfung durchführen (siehe Datenschutzhinweise von Klarna).

14. Änderungen
Wir passen diese Datenschutzerklärung an, wenn sich unsere Website oder die Rechtslage ändert. Es gilt die jeweils hier veröffentlichte Fassung.

2. Hosting and shop system (Big Cartel)
Our shop runs on the platform of Big Cartel, LLC, 50 W. Broadway #333 PMB 40632, Salt Lake City, UT 84101, USA. Big Cartel provides the website, bag and checkout and processes the data arising from visits and orders. Each page request involves technical access data (IP address, date and time, requested page, browser, operating system, referrer). This is necessary to deliver the website securely and reliably (Art. 6(1)(f) GDPR). Big Cartel also uses the security and delivery service Cloudflare. Data may be transferred to the USA; according to Big Cartel, such transfers are safeguarded by EU Standard Contractual Clauses or a recognised adequacy mechanism. 3. Orders
When you order, we process the data entered at checkout (name, delivery and billing address, email address, phone number if provided, items ordered, payment status) to perform the contract, ship the goods and communicate with you (Art. 6(1)(b) GDPR). For delivery, we pass your name and delivery address to the carrier (DHL/Deutsche Post, Hermes, DPD or UPS). Due to commercial and tax law, we keep order and invoice data for up to 10 years (Art. 6(1)(c) GDPR).

4. Payment providers
Depending on the payment method you choose, your payment data is transmitted to the respective provider (Art. 6(1)(b) GDPR; fraud prevention: Art. 6(1)(f) GDPR):

5. Cookies and similar technologies
When you first visit our shop, we ask for your choice in the cookie bar at the bottom of the page ("cookies.exe"). You can use the shop right away – nothing is blocked while you decide. You can change your choice at any time via "Cookie settings" in the footer.

Necessary (always active, no consent required – Sec. 25(2) TDDDG, Art. 6(1)(b) and (f) GDPR):
• cart – keeps your shopping bag (Big Cartel)
• tfe_consent – stores your cookie choice (12 months)
• tfe_drop_seen (local storage) – remembers when you last saw the "new drop" window, so it only appears once per hour
• Session storage (tfe-booted, tfe-nd, tfe-wd) – remembers the intro animation, caches drop info and keeps entries of the withdrawal function until sent; deleted when you close the browser
• Cloudflare security cookies (e.g. __cf_bm, cf_clearance) – protection against bots and attacks
• Stripe (__stripe_mid, __stripe_sid) and PayPal – fraud prevention for secure payment

Statistics (only with your consent – Sec. 25(1) TDDDG, Art. 6(1)(a) GDPR):
• Big Cartel visitor statistics (ident, _bca, visited; stats1.bigcartel.com) – counts visits and viewed products so we can see which pieces are of interest. Only set if you click "Accept".

In addition, our host uses Cloudflare Web Analytics, which works without cookies and only processes technical access data (Art. 6(1)(f) GDPR).
You can withdraw your consent at any time with effect for the future via "Cookie settings".

6. Fonts, videos and scripts
Fonts and videos are delivered via the content delivery network jsDelivr (cdn.jsdelivr.net, operated by Prospect One, Poland; delivered via Cloudflare and Fastly); a program library (jQuery) is loaded via cdnjs (Cloudflare, Inc.). Your IP address is transmitted to the respective provider, possibly also to the USA. We use these services for a fast and reliable presentation of our website (Art. 6(1)(f) GDPR). These services do not set cookies.

7. Contact form, email and Instagram messages
If you contact us via the contact form, by email or by direct message, we process your details to answer your request (Art. 6(1)(b) or (f) GDPR). The contact form is provided by Big Cartel and protected against spam by Google reCAPTCHA (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland); usage data such as IP address and mouse movements are transmitted to Google, possibly also to the USA (Art. 6(1)(f) GDPR – protection against abuse). Our email inbox is provided by Google (Gmail; Google Ireland Limited), Instagram direct messages by Meta Platforms Ireland Limited (Merrion Road, Dublin 4, Ireland); data may be transferred to the USA. reCAPTCHA may set the cookie _GRECAPTCHA. We delete requests once they have been dealt with, unless statutory retention obligations apply.

8. Withdrawal function ("Vertrag widerrufen")
If you use the online withdrawal function, we process your name, email address, order details and the time of your withdrawal in order to process the withdrawal and send you the legally required acknowledgement of receipt (Art. 6(1)(c) GDPR in conjunction with Section 356a German Civil Code). The statement is transmitted to us via Big Cartel's contact form. We send the acknowledgement of receipt by email via Brevo (Sendinblue SAS, see section 9) or from our email inbox (Gmail); with Brevo, your email address and the withdrawal details are stored in a separate list that is not used for marketing. We keep this data as long as necessary for processing and any proof, at most until statutory retention periods expire.

9. Newsletter (Brevo)
If you sign up for our newsletter, we use the email service Brevo (Sendinblue SAS, 106 boulevard Haussmann, 75008 Paris, France) as a processor. We use the double opt-in procedure: you are only added after clicking the link in our confirmation email. We store the time of sign-up and confirmation as proof. Brevo can evaluate whether a newsletter was opened and which links were clicked so that we can improve our emails. The legal basis is your consent (Art. 6(1)(a) GDPR). 10. Links to social networks
Our website links to Instagram, TikTok and YouTube. These are plain links; no data is transmitted to these networks when you visit our shop. Only when you click a link do the respective provider's privacy terms apply.

11. Storage period
We store personal data only as long as necessary for the respective purpose or as required by statutory retention obligations (6, 8 or 10 years under German commercial and tax law).

12. Your rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20), and you can withdraw any consent at any time with effect for the future (Art. 7(3)). Just email us at tfestudijos@gmail.com.

Right to object (Art. 21 GDPR): Where we process data on the basis of Art. 6(1)(f) GDPR (legitimate interest), you can object to this processing at any time on grounds relating to your particular situation.

We update this privacy policy when our website or the law changes. The version published here applies.
